ParkVia is a trading style of ParkCloud Ltd.

1. ParkCloud Ltd er einungis bókunaraðili og því liggur öll skaðabótaábyrgð á bifreiðum hjá bílastæðinu, hótelinu eða hjá þeirri móttökuþjónustu („söluaðila bílastæðisins“) sem pöntuð hefur verið. Þú samþykkir að þú sért að gera bókun í gegnum ParkCloud Ltd, sem aðeins er fyrir bókunarþjónustu á Netinu, og að söluaðili bílastæðisins láti þér bílastæðið í té með beinum hætti þegar þú mætir á bókunarstaðinn. Söluaðilar bílastæðanna eru sjálfstæð fyrirtæki og ekki umboðsaðilar eða starfsmenn ParkCloud Ltd. ParkCloud Ltd ber ekki skaðabótaábyrgð á störfum, mistökum, aðgerðarleysi, fyrirsvari, ábyrgð, brotum eða vanrækslu þjónustuaðilanna eða persónulegum meiðslum, dauða, eignaskaða eða öðru tjóni eða útgjöldum sem af því stafar. ParkCloud Ltd ber enga skaðabótaábyrgð á og býður ekki upp á endurgreiðslu ef kemur til verkfalla, óviðráðanlegra atburða eða annarra orsaka sem liggja utan beinnar stjórnar fyrirtækisins. Einnig er engin ábyrgð er tekin á frekari kostnaði, aðgerðarleysi, töfum, endurbeiningum eða aðgerðum stjórnvalda eða yfirvalda.

2. ParkCloud Ltd fylgist með verðlagi til þess að bjóða upp á gott verð. Verð geta hækkað og lækkað vegna árstíðabundinna sértilboða. Öll verð, sem sýnd eru, eru fyrir forbókun á Netinu og innihalda öll verð söluaðila bílastæðisins virðisaukaskatt (eða samsvarandi skatt í viðkomandi landi) til greiðslu í landi söluaðilans auk þess sem þau innihalda aðra skatta og gjöld, nema annað sé tekið fram. Ekki eru tekin gjöld fyrir greiðslur, sama hvaða greiðsluaðferðir eru notaðar.

3. Bókunar- og afbókunarferlar

  • 3.1 Við bókanir í gegn um vefsíðuna ParkCloud Ltd eru bókunarmiðar sjálfkrafa búnir til við lok bókunarinnar . Bókun er hins vegar ekki trygging um stæði. ParkCloud Ltd kann að hætta við bókun ef söluaðili bílastæðisins gefur til kynna að hann geti ekki uppfyllt bókunina. Full endurgreiðsla fer fram við slíkar kringumstæður.
  • 3.2 Vinsamlegast gangið úr skugga um að hafa leiðarvísi og leiðbeiningar við höndina fyrir þá þjónustu, sem bókuð var, ásamt símanúmeri söluaðila bílastæðisins og upplýsingum um hvernig á að fara inn á og út úr bílastæðinu. Það er á þína ábyrgð að fá réttar leiðbeiningar áður en þú leggur af stað – tapaðar bókanir, flug eða önnur vandamál sem stafa af því að þú varðst þér ekki úti um réttar leiðbeiningar, verða ekki endurgreiddar af ParkCloud Ltd.
  • 3.3 Ef söluaðili bílastæðisins innheimtir hærra verð en kemur fram á bókunarmiðanum þínum vegna þess að þú fylgdir ekki réttum bókunarferlum, ferlum við innakstur eða útakstur eða vegna þess að þú gast ekki lagt fram bókunarmiða getur ParkCloud Ltd ekki fengið endurgreiðslu fyrir þína hönd.
  • 3.4 Flutningur kann að vera innifalinn í verðinu frá ParkCloud Ltd en vinsamlegast athugaðu upplýsingarnar um söluaðila bílastæðisins, sem koma fram á vefsíðunni, eða hafðu samband við ParkCloud Ltd áður en þú gerir bókun þína til þess að fá staðfestingu á því.
  • 3.5 Lágmarksgeymsla gildir á sumum bílastæðum. Ef þú vilt nota færri daga getur þú gert slíkt en greiða þarf kostnaðinn fyrir lágmarksgeymsluna. Öll uppgefin verð munu innihalda gjaldið fyrir lágmarksgeymsluna.
  • 3.6 Dagverð kunna að breytast eftir dögum, lengd geymslutíma, afhendingartíma bifreiðar og hvenær hún er sótt.
  • 3.7 Það fer eftir söluaðila bílastæðisins og þeirri vöru, sem þú hefur valið, hvort þú þarft að skilja lyklana þína eftir hjá starfsfólki söluaðila bílastæðisins. Vefsíða ParkCloud Ltd mun segja til um hvenær slíkt á við. Í slíku tilviki þarft þú að tryggja áður en þú skilur bifreið þína eftir hjá söluaðila bílastæðisins að hún sé í ökuhæfu ástandi og að hún uppfylli allar gildandi reglur (t.d. tryggingar). Söluaðili bílastæðisins áskilur sér rétt í þessu tilviki að færa bifreið þína á eða utan bílastæðisins með akstri hennar eða með öðrum hætti, sem söluaðili bílastæðisins eða starfsmenn hans telja nauðsynlegan, við skilvirka tilhögun bílastæðanna á viðkomandi stað, í neyðartilvikum eða til þess að koma í veg fyrir slys eða hindranir. Ef bílstjórar söluaðila bílastæðisins þurfa að aka bifreið þinni á aðalvegum skal söluaðili bílastæðisins að fullu tryggja bílstjóra sína í þeim tilgangi, hins vegar ættu viðskiptavinir sjálfir að sannreyna það.
  • 3.8 Skilmálar og skilyrði hvers og eins söluaðila bílastæða gilda um viðkomandi bílastæði. Það er á þína ábyrgð að óska eftir skilmálum og skilyrðum söluaðila bílastæðisins við komu þína.
  • 3.9 Allar innsláttarvillur, sem leiða til þess að bílstjórar söluaðila bílastæðisins þurfa að bíða, eða seinkanir viðskiptavina kunna að leiða til aukagjalds sem greiða þarf bílstjóranum strax.
  • 3.10 Háar eða breiðar bifreiðar: Ekki öll bílastæði geta tekið við bifreiðum í yfirstærð, sendiferðabílum, húsbílum o.s.frv. og ef þau gera slíkt kann það að vera gegn aukagjaldi. Nema annað sé tekið fram í upplýsingum ParkCloud Ltd um bílastæðið, gilda bókanir um stöðluð bílastæði aðeins um smáar til meðalstórar bifreiðar. Ef bifreið er ekki í þeim flokki er það á ábyrgð viðskiptavinarins að velja rétta gerð af ökutæki á bókunareyðublaðinu, eða ef slíkt er ekki í boði, að hafa samband við ParkCloud Ltd áður en bókað er. ParkCloud Ltd verður ekki við beiðnum um endurgreiðslu á aukagjöldum á bílastæðinu ef viðeigandi gerð af ökutæki er ekki tilgreind í bókuninni, eða ef söluaðili bílastæðisins getur ekki tekið á móti viðeigandi ökutækjagerð.
  • 3.11 ParkCloud Ltd ráðleggur viðskiptavinum sínum að mæta tímanlega á bílastæðið fyrir áframhaldandi ferðalög.
  • 3.12 Öllum bifreiðum er lagt á ábyrgð viðskiptavinarins. Komi fram kvörtun, krafa eða ágreiningur (t.d. ef bifreiðin verður fyrir skaða þegar hún er hjá söluaðila bílastæðisins, eða ef bifreiðin, eða fylgihlutir hennar týnast þegar hún er hjá söluaðila bílastæðisins) skal viðskiptavinurinn ræða milliliðalaust við söluaðila viðkomandi bílastæðis. ParkCloud Ltd tekur við engar kringumstæður ábyrgð á slíku. Allar kröfur um tap eða skemmdir á bifreiðum eða varðandi þjónustugæði ætti að beina milliliðalaust til söluaðila bílastæðisins. ParkCloud Ltd veitir upplýsingar um hvernig hafa má samband við söluaðila bílastæðisins, ef óskað er eftir slíku. Þetta hefur ekki áhrif á lögbundin rétt þinn sem neytanda.
  • 3.13 ParkCloud Ltd (stundar viðskipti sem ParkCloud Ltd) tekur ekki gjald fyrir breytingar eða afbókanir. Hins vegar innheimta sumar bílastæðaþjónustur umsýslukostnað og –gjöld. Þar sem slíkt á við er það tekið fram við bókunina og í tölvupóststilkynningunni með bókunarmiðanum
  • 3.14 Nokkrir söluaðilar bílastæða taka fram að kaup á þjónustu þeirra séu óendurkræf og / eða verði ekki breytt. Þar sem slíkt á við er það tekið fram við bókunina og í tölvupóststilkynningunni með bókunarmiðanum.
  • 3.15 Öll bílastæðaþjónusta fellur undir skilmála og skilyrði viðkomandi söluaðila bílastæðisins. Það er á þína ábyrgð að óska eftir skilmálum og skilyrðum söluaðila bílastæðisins við komu þína.

4. Vefsíða ParkCloud Ltd er með vefhlekki á vefsíður þriðju aðila. ParkCloud Ltd stjórnar þeim vefsíðum ekki og ber ekki ábyrgð á innihaldi þeirra eða á samningsbrotum eða aðgerðum þriðju aðila af ásetningi eða gáleysi sem leiða til taps, skaða, seinkunar eða slysa hjá þér eða samferðamönnum þínum. ParkCloud Ltd ber hvorki ábyrgð á nákvæmni þeirra skoðana sem birtast á slíkum vefsíðum né heldur rannsakar PrimearAirParking.com, hefur eftirlit með eða kannar áreiðanleika þeirra né ítarleika. Vefhlekkir á vefsíðu ParkCloud Ltd gefa ekki til kynna né fela í sér samþykki eða stuðning ParkCloud Ltd á viðkomandi vefsíðu sem hlekkjað er á. Ef þú ákveður að yfirgefa vefsíðu ParkCloud Ltd til þess að fara á þessar síður þriðja aðila að þá er það á þína eigin ábyrgð. Allar reglur, stefnur (þar á meðal um friðhelgi) og notkunarferlar vefsíðna þriðju aðila gilda um þig þegar þú ert á viðkomandi síðu. ParkCloud Ltd ber ekki ábyrgð á upplýsingum sem þriðju aðilar veita þér.

5. Allt efni vefsíðunnar ParkCloud Ltd er höfundarréttur ParkCloud Ltd. Allur réttur áskilinn. Aðrar vörur og fyrirtæki, sem nefnd eru hér, kunna að vera vörumerki viðkomandi eigenda. Myndir á vefsíðu ParkCloud Ltd eru einungis til skoðunar og má ekki vista þær eða hlaða þeim niður á neinu sniði. Allir dómar viðskiptavina á vefsíðu ParkCloud Ltd fela ekki í sér skoðanir ParkCloud Ltd.

6. Upplýsingar, hugbúnaður, vörur og þjónusta, sem koma fram á vefsíðu ParkCloud Ltd, kunna að vera ónákvæmar eða innihalda innsláttarvillur. Einkum ber ParkCloud Ltd enga ábyrgð á og vísar frá allri skaðabótaábyrgð á ónákvæmni, sem tengist upplýsingum um og lýsingu á bílastæðahúsinu og öðrum ferðavörum í boði á þessari vefsíðu (þar á meðal, en takmarkast ekki við, ljósmyndir, lýsingar á þjónustu, almennar lýsingar, o.s.frv.), sem að miklu leyti eru á vegum viðkomandi söluaðila. Allir dómar, sem birtast á vefsíðunni, eru hugsaðir til viðmiðunar en ParkCloud Ltd tryggir ekki nákvæmni þeirra. Af og til eru breytingar gerðar á þessum upplýsingum. ParkCloud Ltd og/eða viðkomandi söluaðilar kunna að gera úrbætur og/eða breytingar á vefsíðunni hvenær sem er. ParkCloud Ltd og/eða viðkomandi söluaðilar segja ekkert til um nothæfi upplýsinganna, varanna og þjónustunnar á vefsíðu ParkCloud Ltd sama hver tilgangurinn kann að vera. Auk þess felur sala á vörum eða þjónustu á verfsíðu ParkCloud Ltd ekki í sér stuðning eða meðmæli ParkCloud Ltd með viðkomandi vörum eða þjónustu. ParkCloud Ltd og/eða viðkomandi söluaðilar undanskilja sig allri ábyrgð, skilmálum og skilyrðum er varðar upplýsingar á síðunni, hugbúnað, vörur og þjónustu, þar með talið allar ábyrgðir og skilyrði, sem gefnar hafa verið til kynna, um gæði, hæfi í ákveðnum tilgangi, eignarhald og virkni án lögbrota. Söluaðilar bílastæðanna eru sjálfstæð fyrirtæki og ekki umboðsaðilar eða starfsmenn ParkCloud Ltd. ParkCloud Ltd ber ekki skaðabótaábyrgð á störfum, mistökum, aðgerðarleysi, fyrirsvari, ábyrgðum, brotum eða vanrækslu þjónustuaðilanna eða persónulegum meiðslum, dauða, eignaskaða eða öðru tjóni eða útgjöldum sem af því stafar. ParkCloud Ltd ber enga skaðabótaábyrgð á og býður ekki upp á endurgreiðslu ef kemur til verkfalla, óviðráðanlegra atburða eða annarra orsaka sem liggja utan beinnar stjórnar fyrirtækisins. Einnig er engin ábyrgð tekin á frekari kostnaði, aðgerðarleysi, töfum, endurbeiningum eða aðgerðum stjórnvalda eða yfirvalda. ParkCloud Ltd og söluaðilar bera ekki skaðabótaábyrgð undir neinum kringumstæðum á óbeinu, tilfallandi, refsiverðu, sérstöku eða afleiddu tjóni, sem hlýst af eða tengist með einhverjum hætti notkun vefsíðunnar ParkCloud Ltd, eða á töfum eða vangetu til að nota vefsíðuna ParkCloud Ltd eða á upplýsingum, hugbúnaði, vörum eða þjónustu, sem fengin er í gegnum vefsíðuna ParkCloud Ltd eða stafar með öðrum hætti af notkun vefsíðunnar ParkCloud Ltd (þar á meðal en takmarkast ekki við, afnotamissi, tap á gögnum, hagnaði, sparnaði eða tækifærum) hvort sem slíkt byggist á samningi, strangri skaðabótaskyldu eða með öðrum hætti, jafnvel þó að ParkCloud Ltd og/eða söluaðilum hafi verið bent á möguleikann á tjóni. ParkCloud Ltd og/eða viðkomandi söluaðilar bera skaðabótaábyrgð á beinu tapi af völdum notkunar vefsíðunnar ParkCloud Ltd, hvort sem það byggist á samningi, strangri skaðabótaskyldu eða með öðrum hætti, að hámarki því heildarverði viðskipta, sem krafan snýst um, hvort sem um er að ræða einn einstakan atburð eða röð tengdra atburða. Þessir skilmálar og skilyrði og framangreindir fyrirvarar á skaðabótaskyldu hafa ekki áhrif á lögbundinn neytendarétt þinn.

7. Þú samþykkir að verja og halda ParkCloud Ltd, hlutdeildarfélögum þess og/eða viðkomandi söluaðilum og yfirmönnum, framkvæmdastjórum, starfsmönnum og umboðsmönnum skaðlausum af kröfum, aðgerðum, tilkalli, endurgreiðslum, tapi, skaða, sektum, viðurlögum eða öðrum kostnaði eða útgjöldum af einhverju tagi eða eðli þar á meðal, en takmarkast ekki við, sanngjarnan lögfræði- og bókhaldskostnað þriðja aðila vegna:

  • (a) brota þinna á þessum skilmálum, skilyrðum og fyrirvörum eða skjalanna sem hér er vísað til;
  • (b) brota þinna á lögum eða réttindum þriðja aðila; eða
  • (c) notkunar þinnar á vefsíðu ParkCloud Ltd.

8. Sem skilyrði fyrir notkun þinni á vefsíðunni ParkCloud Ltd, ábyrgist þú gagnvart ParkCloud Ltd að þú munir ekki nota vefsíðuna ParkCloud Ltd í ólögmætum eða óheimiluðum tilgangi samkvæmt þessum skilmálum, skilyrðum og fyrirvörum.

  1. THESE TERMS
    1. What these Terms cover. These are the Terms on which we, together with select Third Party Suppliers, supply access to Services to you.
    2. Why you should read them. Please read these Terms carefully before you submit your booking with us. These Terms tell you who we are, how we will provide access to Services to you, how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these Terms, please contact us to discuss.
  2. INFORMATION ABOUT US AND HOW TO CONTACT US
    1. Who we are. We provide travel services including, for example, pre-booked vehicle access to car parking that is made available by Third Party Suppliers. We are a company registered in England and Wales with company registration number 6557569 and registered office at Peter House, Oxford Street, Manchester M1 5AN, UK. Our registered VAT number is GB983077586.
    2. How we may contact you. If we have to contact you we will do so by telephone or by writing to you at the email address or postal address you provided to us in your booking. It is your responsibility to ensure that the contact details you provide to us are correct; if you provide the wrong details to us, we will not be responsible for the consequences of any failure by you to receive any contact from us or the relevant Third Party.
    3. “Writing” includes emails. When we use the words “writing” or “written” in these Terms, this includes emails.
    4. Defined terms used in these Terms:
      1. “Contract” means the agreement between us and you under which we will provide access to Services to you and you will pay us for the Services, as set out in the relevant booking that you submit to us for the Services, which is subject to these Terms.
      2. “Services” means the provision by us to you of access to pre-booked vehicle parking spaces, airport security fast track lanes, lounges and other travel services.
      3. “Third Party Supplier” or “Third Party Suppliers” mean the suppliers we contract with in order to provide the Services that we are making available to you under the Contract.
      4. “Website” means our website at https://www.parkcloud.com or https://www.parkvia.com through which you are able to submit bookings for Services from time to time; please note that your initial enquiry in respect of Services may have been made through a different website, but any booking you submit will be funnelled to and made through https://www.parkcloud.com or https://www.parkvia.com.
  3. OUR CONTRACT WITH YOU
    1. Placing a booking. You can place a booking for Services on the Website by following the Website booking process.
    2. How we will accept your booking. Our acceptance of your booking will take place when we email a booking voucher to you, at which point a Contract will come into existence between you and us.
    3. If we cannot accept your booking. If we are unable to accept your booking, we will inform you of this in writing and will refund you for the Services as per the arrangements set out in clauses 8.8 and 8.9 below. This might be because there is no availability in the selected location at the specified time, because of unexpected limits on our resources which we could not reasonably plan for, or because we have identified an error in the price or description of the Services.
    4. Your booking reference. We will assign a booking reference to your booking and tell you what it is promptly after it has been created. It will help us if you can tell us the booking reference whenever you contact us about your booking.
    5. Managing your booking. You can manage your booking, once we have accepted it, in your Account on the Website. You will need to provide some information in respect of your booking so that you can access it in full.
  4. REGISTRATION FOR AN ACCOUNT
    1. Requirement for an Account: When you submit your booking to us through the Website, we will create an account for you on the Website (an “Account”) to manage your booking and accessed through the “Manage My Booking” tab. Instructions on how you can access your Account will be provided to you with your booking voucher.
    2. Account creation: In order for your Account to be created, we will use your name, email address and possibly some other personal information as provided to us when you placed your booking. See our Privacy and Cookies Policy for more details about this. By making a booking and therefore allowing us to create an Account for you, you warrant that you are at least 16 years of age.
    3. Valid email address: An Account must be created with a valid email address that you access regularly, so that, amongst other things, we can send administration and information emails to you. Any Account created with another person’s email address or with a temporary email address may be closed by us without notice. We may also require you to validate your Account on its creation or if we believe that you have provided us with an invalid email address. Once we have created an Account for you, you cannot change your email address for accessing the Account.
    4. Rejection: We reserve the right to refuse use of or access to any Account or the Website to anyone for any reason, at our absolute discretion. If we do this, and you need to contact us about an existing booking, please contact us on the details given at clause 9.1 below.
    5. Protect your details: When an Account is created for you, you will be provided with access details so that you can access the Account. You must keep the access details confidential and immediately notify us if there is any unauthorised use of your email address or your Account or any breach of security otherwise known to you. You acknowledge that any person to whom your access details are disclosed is authorised to act as your agent for the purposes of using (and/or transacting via) your Account. Please note that you will be entirely responsible if you do not maintain the confidentiality of your access details.
  5. SERVICES

    Services may vary slightly from their description on the Website. Although we have made every effort to describe services accurately, they may vary slightly from those descriptions, including, without limitation, due to Third Party Suppliers making changes to the services available to us.

  6. YOUR RIGHTS TO MAKE CHANGES

    If you wish to make a change to the Services you have booked, please do so by accessing your Account. We will let you know if the change is possible. If it is possible we will let you know about any changes to the price of the Services or anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change.

  7. OUR RIGHTS TO MAKE CHANGES
    1. Minor changes to the Services. We or the relevant Third Party Supplier may change the Services:
      1. (a) to reflect changes in relevant laws and regulatory requirements; and
      2. (b) to implement minor improvements, for example to address security or safety issues.
      We will use our reasonable efforts to ensure that any such changes will not affect your use of the Services.
    2. More significant changes to the Services and these Terms. In addition, we may make other, more significant changes to these Terms or the Services, but if we do so we will notify you and you may then contact us to end the Contract before the changes take effect and receive a refund for any Services paid for but not received.
  8. ACCESSING THE SERVICES
    1. When we will provide the booking voucher. Once your booking has been processed and we have accepted it, we will send you a booking voucher by email, which will contain details of how you can access the Services.
    2. When the Services will be provided. We, or a Third Party Supplier, will provide access to the Services which will begin and end on the dates set out in the booking.
    3. You are responsible to arrive at the time stated on the booking. Please make sure you have directions, instructions and a telephone number for the Services you have booked, and details of the entry and exit procedures. It is your responsibility to obtain valid directions before departing – we will not provide a refund for any missed bookings, flights or events, or other problems arising from your failure to obtain valid directions or instructions before the Services commenced. If the Third Party Supplier’s employees are kept waiting because of your late arrival (including, but not limited to, where they are waiting for you to give them your car keys), this may result in an administration charge, issued independently by the Third Party Supplier to you, and payable directly by you to them at that time, or the withdrawal of the Parking Service from you with no refund. Further information can be obtained directly from the Third Party Supplier, whose contact details will be on your booking voucher.
    4. Moving your vehicle. Depending on the Parking Service you have chosen, you may have to leave your vehicle keys with a Third Party Supplier. In this case, you must ensure, before leaving your vehicle, that it is in a roadworthy condition and that it has all applicable regulatory requirements (e.g. insurance) in place. The Third Party Supplier reserves the right to move your vehicle within or outside of the relevant car park by driving or otherwise to such extent as it may, at its discretion, think is necessary for the efficient arrangement of its parking facilities, in emergencies or to avoid accidents or obstructions. If the Third Party Supplier needs to take your vehicle on the public highway, its drivers will be fully insured by the Third Party Supplier for this purpose.
    5. Your vehicle is assumed to be small or average sized. Not all Third Party Suppliers can accommodate oversized vehicles, vans, camper-vans etc. and, if they are accepted, there may be an extra charge. Unless specified within the car park information provided on the Website, any bookings for the Services are valid only for small/average-sized cars. If a vehicle does not fit into this category, it is your responsibility to select the appropriate vehicle type when placing your booking, or, if the option you need is not available, it is your responsibility to contact us before booking for that vehicle. We will not accept refund requests for any supplement charged at the car park if the appropriate vehicle type is not specified when booking, or if the vehicle type cannot be accepted by the Third Party Supplier.
    6. We are not responsible for events outside our control. If supply of the Services is delayed by an event outside our control, which was not foreseeable by us or you at the time that you made your booking, then, subject to clause 11.2 below, we will not be liable for such delay or any loss flowing from that delay. If an unforeseeable delay occurs, we will contact you as soon as possible to let you know and we, or the relevant Third Party Supplier, will take reasonable steps to minimise the effect of any delay. Provided this happens, we will not be liable for delays caused by the unforeseeable event, even where this means that the Services are unavailable for any part, or the entirety, of the period of time for which you have booked them. In such circumstances we suggest that you contact your insurer.
    7. Your legal rights if the Services are not available. You have legal rights if the Services are not available on the date and time confirmed when we accepted your booking. If the Services are not available, you may treat the Contract as being at an end straight away; you may contact us to end the Contract and receive a refund for any Services you have paid for but not received. If you do not wish to treat the Contract as at an end, you may request a new booking for a later date. Provided we can meet this request, we will then let you know if there is any change to the cost of the Services and if there is we will either refund any difference in price, or inform you of the payment required by you to bring the total payment made up to the appropriate level, and then confirm the booking.
    8. How we will refund you. We will refund you the price you paid for the Services by the method you used for payment, or by bank transfer where the method you used for payment is no longer available.
    9. When your refund will be made. We will make any refunds due to you as soon as possible and, in any event, within 14 days of receiving confirmation of your cancellation of your booking.
  9. IF THERE IS A PROBLEM WITH YOUR BOOKING
    1. How to tell us about problems. If you have any questions or complaints about the Services, please contact us. You can write to us using the contact details on the Website with any questions or complaints. Please note that all complaints must be made in writing.
    2. Your legal rights. We are under a legal duty to supply services that are in conformity with this Contract. Nothing in these Terms will affect your legal rights. The Consumer Rights Act 2015 says that you can ask us to repeat or fix a service if it is not carried out with reasonable care and skill, or get some money back if we cannot fix it.
  10. PRICE AND PAYMENT
    1. Where to find the price for the Services. The price of the Services (which includes VAT) will be the price indicated on the booking pages when you placed your booking.
    2. When you must pay and how you must pay. We accept payment by various methods which will be set out at the time of booking. You must pay in full at the point of submitting your booking.
    3. What to do if you think an invoice is wrong. If you think the amount you have paid, or been asked to pay, is wrong, please contact us promptly to let us know.
  11. OUR RESPONSIBILITY FOR LOSS OR DAMAGE SUFFERED BY YOU
    1. We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this Contract or failing to use reasonable care and skill in the provision of access to Services made under this Contract, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the Contract was made, we and you knew it might happen, for example, if you discussed it with us during the sales process.
    2. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; or for breach of your legal rights in relation to the Services; subject to the foregoing of this clause 11.2, we will not be liable for the acts or omissions of Third Party Suppliers.
    3. We are not liable for business losses. We only provide access to the Services for domestic and private use. If you use the Services for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
    4. We are responsible for your booking for Services only. We accept liability in respect of your booking for Services only. Your access to, and presence in, any car park is subject to the relevant Third Party Supplier’s terms and conditions (which may include, without limitation, not leaving valuables in your car, and parking being at your own risk); you can get a copy of these terms and conditions directly, and they may be available in the car park itself. You acknowledge that we are not responsible for any faults or damage to, or theft of, any property whilst you are in the car park or accessing the Services, subject to clause 11.2 above.
  12. HOW WE MAY USE YOUR PERSONAL INFORMATION
    1. How we will use your personal information. We will use the personal information you provide to us:
      1. to supply access to the Services to you, which may involve providing your personal information to Third Party Suppliers;
      2. to process your payment for the Services; and
      3. if you agreed to this during the booking process, to give you information about our other services, but you may stop receiving this at any time by contacting us on the details provided on our Website.
    2. When we will pass your personal information on to third parties. We will only give your personal information to third parties (other than Third Party Suppliers) where the law either requires or allows us to do so.

Images on the Website are incorporated for viewing purposes only and may not be saved or downloaded in any format. Any customer reviews featured on the Website do not represent our opinions.

  14. OTHER IMPORTANT TERMS
    1. We may transfer this agreement to someone else. We may transfer our rights and obligations under our Contract with you to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not adversely affect your rights under the Contract. If you are unhappy with the transfer, you may contact us to end the Contract within seven days of us telling you about it and we will refund you any payments you have made in advance for Services not yet received.
    2. You need our consent to transfer your rights to someone else. You may only transfer your rights or your obligations under your Contract with us to another person if we agree to this in writing. Please note that each booking is in respect of a specific vehicle and registration number only, so, if you would like to change the vehicle relevant to your booking, you should do so prior to the commencement of the Services through your Account.
    3. Nobody else has any rights under our Contract with you. This Contract is between you and us. No other person shall have any rights to enforce any of its Terms.
    4. If a court finds part of these Terms illegal, the rest will continue in force. Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them, or any parts of them, are unlawful, the remaining paragraphs will remain in full force and effect.
    5. Even if we delay in enforcing this Contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these Terms, or if we delay in taking steps against you in respect of your breaking this Contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.
    6. Which laws apply to your Contract with us and where you may bring legal proceedings. These Terms and any dispute or claim arising out of or in connection with them (including, without limitation, non-contractual disputes or claims) shall be governed by and construed in accordance with English law. You submit to the exclusive jurisdiction of the English courts to settle any dispute or claim arising out of or in connection with these Terms or their subject matter or formation, except where, by law, such dispute or claim must be brought in the jurisdiction in which you are domiciled, or where the relevant law contains mandatory provisions that override such exclusive jurisdiction.

Cancellation Policy

You must make all cancellation and amendment requests using the "My Account" facility on the ParkCloud website or by emailing ParkCloud on the published email address. If you make a cancellation or amendment request verbally, over the telephone or directly to a Parking Provider, your request will not be actioned. When you make a cancellation request using the "My Account" facility, your request will be actioned automatically and the cancellation notice period (defined as the time between your indicated vehicle drop-off date/time and the time ParkCloud is aware of your cancellation) is calculated from the time the cancellation request is made. If you email your cancellation request, it can only be actioned during office hours and the cancellation notice period will be calculated from the moment when ParkCloud actually processes the cancellation request. Customers are therefore advised to carry out cancellation requests using "My Account".

Please note that the following cases will not be refunded:

  • Onward travel changes (including cancelled flights, cruises, train travel etc.): No Refund. It is your responsibility to remain informed of any onward travel changes and to adjust your timetable accordingly, informing ParkCloud of any relevant changes. ParkCloud will not be held accountable if your onward travel changes (e.g. if your flight, cruise or train is cancelled) and you will not be entitled to a refund.
  • Missed shuttle bus: No Refund. Shuttle bus timetables, where applicable, are available on the ParkCloud website and on booking Vouchers provided. It is your responsibility to be aware of shuttle bus operating hours and any scheduled timetables.
  • Missed Meet & Greet driver: No Refund. It is your responsibility to provide accurate meeting times and to inform the driver of any changes, with adequate notice. Should information about the meeting points not be provided on the ParkCloud website or on your booking voucher, it is the customer’s responsibility to obtain this information from the car park operator.
  • In the event of parking at another car park due to late arrival: No Refund
  • In the event of parking at another car park due to not finding the booked car park: No Refund. Directions are included in all booking vouchers and are readily available from ParkCloud with a valid booking. It is your responsibility to ensure you have your booking voucher and direction details with you when you travel.
  • Lack of booking voucher: No Refund. Booking vouchers are sent out automatically by email. Should your booking voucher fail to be delivered, it is your responsibility to contact ParkCloud and ensure you obtain the relevant details.
  • Unused parking days: No refund is available for unused or partially used bookings.
  • Non-accepted vehicle type: No Refund. It is your responsibility to find out which vehicle types can be accommodated, either within the specific car park information provided or by contacting ParkCloud.

Cancellation notice period:

  • Greater than 24 hours before the start date and time: Full refund
  • 24 hours or less before the start date and time: No refund
